DHHS, FDA - Regulatory Counsel

The FDA is seeking Regulatory Counsel to provides legal/regulatory support to the program offices and works collaboratively with staff and management of the Center to maximize the legal/regulatory strength of the Center's programs and actions.

The Regulatory Counsel:
  • Works with the team and the Office to develop and revise policies, programs, regulations, and guidance documents involving the most complex and highest priority matters affecting food and cosmetic compliance.
  • Serves as a recognized government-wide expert in legal/regulatory matters related to his or her areas of responsibility and is frequently called on to advise others concerning Food and Drug Administration (FDA) statutes and regulations.
  • Drafts or reviews proposals for new regulations and policy statements. These regulations and policy statements often result from the need to implement new legislation or from new interpretations of existing legislation.
  • Works as a part of established work groups to develop regulations and guidance advising on compliance with FDA's Good Guidance Practice regulations and other legal/regulatory issues, as well as interfacing with science and regulatory personnel to ensure that regulations and guidance are well-written and consistent with all applicable legal/regulatory/administrative requirements.

PepsiCo, Legal Director

The PepsiCo Law Department is seeking a highly-responsible, detail-oriented team player for its Global Foods Safety & Regulatory Law team.This position is located in Chicago and reports to the Senior Legal Director for Regulatory Law in Purchase, New York.The successful candidate will contribute to providing regulatory advice, support and coordination across PepsiCo’s worldwide businesses on a full time basis with special emphasis on PepsiCo’s Global Nutrition Group in Chicago.

The successful candidate should expect to –
  • Work collaboratively with PepsiCo legal & regulatory affairs colleagues worldwide to develop and provide critical food regulatory (i.e., food safety, labeling, and claims) advice & counsel to PepsiCo’s global innovation teams, with particular focus on initiatives spearheaded by PepsiCo’s Global Nutrition Group (GNG).
  • Provide day-to-day food regulatory advice & counsel to PepsiCo’s U.S.-based businesses.
  • Spot, track, and analyze emerging food regulatory issues of significance for PepsiCo operations worldwide.
  • Assist in coordinating and framing PepsiCo’s response to key food regulatory developments in the US and across the world.
  • Assist in the development of global PepsiCo perspectives, guidelines, and policies relating to consumer-facing nutrition and health-related messages.
  • Assist in the development of global PepsiCo perspectives, guidelines and policies relating to allergens, contaminants, product recalls, traceability and other critical food safety-related issues.
  • Provide legal analysis and support to key cross functional partners (e.g., Communications, Public Policy & Government Affairs, Global Nutrition and Regulatory Affairs; M&A) in addressing food regulatory issues and developments.
  • JD from a top tier US law school
  • 5+ years’ experience with a premier law firm in a regulatory affairs practice group (e.g., FDA, health, agriculture, advertising & marketing/FTC)
  • In house experience with a CPG company strongly preferred but not required
  • Background in nutrition, food science, or public policy/government affairs a strong plus
  • Highly developed legal reasoning and analytical skills
  • Experience in working as part of a team and assuming a leadership role with others from diverse backgrounds and functions
  • Legal counseling skills to provide proactive guidance and support to executives and associates
  • Outstanding ability to identify legal risks and offer solutions that minimize such risks
  • Excellent written and oral communication skills
  • Ability to prioritize readily and adapt quickly to changing priorities
  • Function at a high level with minimal direction and supervision

The VP Regulatory & Scientific Affairs is responsible for quality, regulatory & scientific affairs involving governmental product regulatory and nutrition policy matters and for quality and food safety support to business units as they relate to ADM products. To this end the VP Regulatory & Scientific Affairs manages a cross-disciplinary group of scientists, quality and regulatory professionals who establish sound science and practices in order to interpret, evaluate and act on regulatory matters affecting the safety and compliance of ADM products.

Essential Duties and Responsibilities

  • Provide strategic product regulatory, nutrition science and policy guidance 
  • Assess product safety issues for ADM products
  • Help minimize adverse regulatory risks to the business 
  • Advice management on matters of food safety and regulatory risk associated with developing science-based issues which could adversely affect the business, by monitoring regulatory agencies, and assessing technical and regulatory information. Propose solutions to mitigate risk 
  • Achieve new product approvals for food, feed and industrial products with US and international governments globally, where regulatory systems exist by writing and submitting approval dossiers 
  • Conduct product safety determinations and human clinical trials to support product approvals, ensure compliance and support marketing claims; 
  • Provide guidance and interpretations to management between the science and legal basis for food, feed and industrial products’ compliance and their manufacture 
  • Monitor and influence current and future changes to US and global product regulation and nutrition policy affecting ADM businesses by participating in regulatory agencies’ forums and with direct information exchange with regulators and influential organizations. 
  • Participate on technical-regulatory issues committees in various industry organizations to influence policy and issues management 
  • Conduct safety and international product regulatory compliance evaluations 
  • Assuring compliance by conducting periodic training and audits for quality programs


  • Advanced scientific degree in nutrition, (micro)biology, biochemistry, chemistry, toxicology or related field is preferred; or science degree in these fields with proven, broad experience with product regulatory and quality matters associated with the grain processing industry 
  • 5 to 10 years’ experience in regulatory affairs involving food, feed and industrial products and their manufacture 
  • Experience with interacting with FDA, EPA, USDA, AAFCO, FTC and international regulators is required 
  • Be familiar with HACCP and product quality assurance programs 
  • Strong (written and verbal) communication skills 
  • Ability to interact effectively with government officials and third parties
  • High ethical standards 
  • Ability to bridge between legal counsel and technical issues is required
