The Food and Drug Law Institute (FDLI) is a nonprofit membership organization that offers education, training, publications, and professional engagement opportunities in the field of food and drug law. As a neutral convener, FDLI provides a venue for stakeholders to inform innovative public policy, law, and regulation. FDLI’s scope covers all industries regulated by the U.S. Food and Drug Administration (FDA) and related agencies and authorities in the U.S. and globally, including drugs, medical devices, biologics, food, dietary supplements, cosmetics, cannabis, veterinary, and tobacco products.

FDLI is seeking a Director, Educational Programs to serve as a key member of FDLI’s senior leadership team. This position is responsible for the strategic planning as well as the day-to-day oversight of the majority of FDLI’s programs via a team of six people. As an important face of the organization, this role requires a high level of networking with the key stakeholders in the food and drug law community, as well as an understanding of a variety of issues in the FDA-regulated space. The Director, Educational Programs speaks publicly, leads committees, and works closely with FDLI members and staff.

Attendance in-person at events in DC throughout the year is required and the Director must reside in the Washington, DC-Metro region. The position reports to the President & CEO.

Compensation & Benefits

WHO ARE WE

The Texas Department of Agriculture’s Legal Services Division provides legal counsel to TDA executive staff, divisions and programs, and a variety of boards and advisory committees.

WHAT YOU’LL DO

The Assistant General Counsel will provide advanced legal services for the Trade and Business Development Division’s Office of Rural Affairs, State Office of Rural Health, and Grants Office of the Texas Department of Agriculture (TDA) including supporting the Community Development Block Grant Program, rural health grant programs, Texas Agricultural Finance Authority, agricultural grant programs and other federally and state funded rural economic development grant programs and related boards and committees. You will provide legal advice to TDA staff administering the programs; drafting and/or reviewing correspondence, solicitation requests, contracts, program guides, and rules; and implementing legislation regarding the programs. You will work under minimal supervision with considerable latitude for the use of initiative and independent judgment.

PRIMARY RESPONSIBILITIES

Provide legal support for the Trade and Business Development Division’s Office of Rural Affairs, State Office of Rural Health, Texas Agricultural Finance Authority, and Grants Office, as assigned, to include: providing legal advice to TDA staff administering federally and state funded rural community and economic development and rural health programs; drafting and/or reviewing correspondence, solicitations such as requests for proposals, qualifications, or grant applications, contracts, grant agreements and amendments, program implementation manuals, program application guides, and rules; and implementing legislation regarding the programs.

Research and provide legal analysis on state and federal laws and regulations.

Review contract performance issues, findings of noncompliance and breach of contract issues, and provide legal support and advice to programs on such matters.

Attend various advisory committee and board meetings and provide legal support to program committees and boards.

Research and draft legal memoranda on issues for programs and TDA executive staff.

Attend program staff meetings, including briefings on grant awards and issues related to program implementation, and provide legal support to programs on such matters.

Serve as a staff attorney providing program support in the area of administrative law, including agency rulemaking, public information requests and compliance with open meetings.

Serve, as needed, as one of the agency’s liaisons with the Office of the Attorney General regarding litigation involving the agency, to include preparing subpoenas, records and documents for civil litigation and assist in preparing cases for court trial and assist in representing the agency in matters before court, as appropriate.

Serve as counsel for programs in administrative hearings, including drafting briefs, preparing witnesses for testimony, and representing TDA at the hearings.

Qualifications

MINIMUM QUALIFICATIONS

J.D. or LL. B. Degree from an accredited four-year college or university with a license to practice law in the State of Texas.

5 years of work experience working as a licensed attorney.

Recent work experience in contracts and administrative law.

Work experience performing legal research and preparing legal memoranda and documents.

Experience making presentations to groups.

PREFERRED

Experience working with federal and/or state grant programs.

Experience working as an attorney in a governmental entity in Texas.

Mastery of statutes, regulations, and legal precedents related to major USDA program areas or relevant subject matter expertise to provide expert legal advice in regard to the assigned program area, develop or recommend litigation strategies and procedures, aid the Department of Justice in the trial of important or precedent-setting cases, and negotiate or participate in negotiating settlements on behalf of the Department.

Mastery of a large and complex body of law in which precedents are frequently conflicting or non-existent to make determinations and reach conclusions which guide the Department or the Agency in resolving subsequent, similar problems; provide legal advice to heads of programs and Agencies on complex and difficult legal questions or factual issues; and write opinions and case assessment memoranda after conducting detailed factual and legal research.

Mastery of the principles and techniques of legal analysis and practice in order to prepare pleadings, motions, briefs, litigation reports, and related documents in connection with suits by and against the Government and determine in each case the nature of action or defense, the legal issues involved, the most effective course of action, and optimal strategies and tactics to be employed.

Comprehensive knowledge and understanding of missions and functions of the USDA and its agencies or relevant subject matter expertise, as appropriate in order to provide legal services in support of USDA programs and activities that are consistent with the strategic goals of USDA and the priorities of the Secretary of Agriculture.

Mastery of the principles and techniques of written and oral communication to speak and write with clarity and tact to provide guidance on complex legal issues, secure acceptance of recommendations, prepare complex legal opinions, and effectively represent the Department in a variety of external interactions. NOTE: This experience must be demonstrated on your resume/supporting documents.


Education: Successful completion of a full course of study in a school of law accredited by the America Bar Association (ABA) and have the first professional law degree (J.D. or equivalent degree) (law school transcript required).

Grantee Partnerships & Support

  • Manage relationships with grantees and potential grantees including seeking and performing due diligence on proposals aligned with the Colorado River initiative of the Environment program.
  • Shepherd proposals through the Foundation’s approval process, as well as provide guidance to and work with grantees to achieve significant impact.
  • Assist grantees in developing and implementing maintenance, monitoring, and funding strategies that lead to the achievement of strategic goals.
  • Support Senior Program Officer(s) and team with written materials, grantee convenings, and other learning opportunities.
  • Manage workflow and processes with grantees, across Foundation offices, and with family members.
  • Review budgets for appropriate expenditures, review legal documents, monitor grantee operations, review financial and narrative reports and work with our administrative team to ensure timely payments.
  • Provide responsive and thoughtful advising to grantees; be proactive in anticipating needs, and provide accurate, timely resolution of issues when they arise.
  • Identify potential new partnerships and opportunities including identifying prospective grantees and funding partners.

Collaboration Within Environment Program & Across WFF

  • Collaborate with Foundation colleagues, including members of the Foundation evaluation and communications teams, to implement, refine, and expand the Foundation’s impact.
  • Serve on a cross-cutting team of the Environment program.
  • Help shape strategy implementation plans aligned with the Environment program.
  • Help support other projects and assignments as requested by the Environment team, Foundation leadership, and/or family members.

Essential Duties and Responsibilities

  • Executes key portions of NTF’s legislative and regulatory programs to achieve defined policy goals.
